What We Look At

We review the condition of the property before and after the receiver took control, the repairs and costs charged against your account, how it was marketed, the price achieved, and the comparable sales evidence at the time.

Sale at undervalue. A receiver selling a property must take reasonable care to get its true market value. Where a property went quickly, at auction or to a connected buyer, we set out the comparable evidence and what proper marketing would have looked like.

Accounts, fees and repairs. Receivers’ fees, agents’ charges and repair costs come out of the sale proceeds and add to any shortfall. We check whether the works were needed, whether the costs were reasonable, and whether the work was actually done.

Getting your records. Much of the evidence sits with the lender, the receiver and their agents. We help you obtain it through subject access requests, so the file is complete before any claim is made or defended.

Shortfall Claims

If the lender is pursuing you for a shortfall after sale, how the property was managed and sold goes to the heart of the figure claimed. Our evidence gives you, and your solicitor, an objective basis to test it.
